Terms of Use

These Terms of Use govern the use of the Sunum.App ("Service") platform offered by OptiNode Bilişim Limited Şirketi ("Company"). By using the Service, you are deemed to have accepted these terms.

1. Description of the Service

Sunum.App is a SaaS (Software as a Service) platform that, based on a website URL or PDF document provided by users, produces professional presentations (.pptx), promotional videos (.mp4) and brand visuals (PNG/JPG) through AI-powered content generation technology.

2. Account Creation and Authorization

• You must be 18 years of age or older to use the Service.
• You are obliged to provide accurate, up-to-date and complete information when creating an account.
• You are responsible for account security (password, session). You must notify us immediately if you become aware of any unauthorized access.
• One person may open only one account. If multiple accounts are detected, the accounts may be suspended.
• Transferring or selling an account is prohibited.

3. User Responsibilities

3.1 Content uploaded by the user

• You are solely responsible for the PDFs, URLs, image descriptions, brand materials and other content you upload.
• You declare that the content you upload belongs to you or that you hold the necessary permission/license.
• You will not upload content that infringes third-party copyrights, trademark rights or personality rights.
• It is your responsibility to verify that the URLs provided for content generation are accessible and comply with robots.txt policies.

3.2 Prohibited content

The Service may not be used to generate the following content:

• Illegal content (drug production, forged documents, weapon making)
• Inappropriate content involving children (NEVER — deleted immediately + reported)
• Sexual content, obscenity, nudity
• Hate speech, discrimination, racism
• Incitement to violence, terrorist propaganda, self-harm
• Unauthorized depictions of real persons (deepfakes)
• Misleading/false medical advice or financial advice
• Gambling, betting or financial pyramid content that violates legislation

The system applies automated moderation and manual review. If a violation is detected, your account may be suspended or closed without warning. Amounts already paid may not be refunded in this case.

4. About AI-Generated Content

• AI generation is a probabilistic process; the accuracy, completeness or suitability of the generated content is not guaranteed.
• Reviewing the generated content before publishing it is your responsibility.
• AI-generated content may contain incorrect information, may create copyright issues or may produce unexpected outputs.
• The rights to commercial/personal use of the generated content belong to you — however, the Company is not responsible for infringement of third-party copyrights or trademark rights.
• The terms of use of the AI infrastructure providers we use also apply (particularly with regard to commercial use).

5. Pricing and Payment

• The Service runs on credits. How many credits each production will consume is shown on screen before production starts and is deducted from your account once you confirm. Credits are obtained by purchasing a production package or by topping up credits as a one-off; current package and credit prices are published on the Pricing page.
• Production packages are sold on an annual commitment: the amount is charged once and the package credit is loaded into your account as a lump sum at the start of the period. There is no monthly quota; you use your credit at whatever pace you like. Unused package credit does not carry over at the end of the period. Credits you top up as a one-off never expire and are not lost at the end of a period.
• The free tier is granted credits once a month; presentation files produced with those credits carry a Sunum.App watermark and downloading them is free.
• Payments are made through our bank's Virtual POS infrastructure with 3D Secure. Your card information is not stored by our Company.
• All prices include VAT (unless otherwise stated).
• The right to change prices is reserved. The amount of a confirmed order is fixed.
• There is no right of withdrawal once production has started (Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği) Article 15/1-(ğ) and (h)).
• The Sunum.App+ subscription renews in monthly periods: the period fee is charged every month until cancelled (from the saved card or via a payment link sent by e-mail). The subscription can be cancelled at any time from the Marketing → Membership page; cancellation takes effect at the end of the period, the fee for a paid period is not refunded, and period quotas do not carry over.

6. Intellectual Property

• The Sunum.App brand, logo, software, design and content belong to the Company and are protected under the Law on Intellectual and Artistic Works No. 5846 (Fikir ve Sanat Eserleri Kanunu) and the Industrial Property Law No. 6769 (Sınai Mülkiyet Kanunu).
• The Service, in whole or in part, may not be copied, reproduced, reverse engineered or resold for commercial purposes without written permission.
• You may freely use the outputs you generate for any purpose, including commercial; the Company does not claim any rights over these outputs, and the terms of the infrastructure providers we use also permit commercial use.
• Honest warning: Law No. 5846 defines the owner of a work as "the natural person who creates it". Whether content produced entirely by artificial intelligence will be considered a work, and whether it will benefit from copyright protection against third parties, is not yet settled in Turkish law. Your right of use is not impaired; however, exclusive copyright protection over the output against third parties cannot be guaranteed.
• The Company does not use, sell or publish user content for any purpose other than providing the service.

7. Service Continuity and Limitation of Liability

• The Service is provided "as is" and "as available".
• The Company is not liable for service interruptions, AI generation errors, third-party service outages or indirect damages, with its liability capped at the total of your payments over the last 30 days.
• In cases of force majeure, the service may be temporarily suspended.
• The Company may temporarily suspend the service for scheduled maintenance by giving prior notice.

8. Suspension and Termination of the Account

The Company may suspend or close your account without warning in the following cases:

• Violation of these Terms or the prohibited content rules
• Behavior harmful to system security (DDoS, bots, abuse of automation)
• Unlawful use
• Payment fraud or chargeback
• Fake accounts, use of multiple accounts

You may request closure of your own account at any time via Settings → My Account Data.

9. Notifications

The Company sends notifications regarding your account to the e-mail address you provided during registration or as in-platform notifications. You are obliged to keep your e-mail address up to date.

10. Governing Law and Competent Court

These Terms are subject to the laws of the Republic of Türkiye. In disputes, the Istanbul Central Courts and Enforcement Offices (İstanbul Merkez Mahkemeleri ve İcra Daireleri) are competent, and for consumer disputes the Consumer Arbitration Committees and Consumer Courts (Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri) of the province/district of the consumer's residence are also competent.

11. Changes to the Terms

The Company reserves the right to make changes to these Terms. Significant changes are notified by e-mail 14 days before they take effect. Your continued use of the Service after the changes means that you accept the new Terms.
